A MAN who racially abused a bus driver, policeman and neighbour has walked free from court having already served time in jail.

Michael McDonagh was jailed for 10 months at Oxford Crown Court yesterday having admitted four racially aggravated public-order offences.

But the 31-year-old, formerly from Barton but now living in Cumberland Road, East Oxford, was released having served 22 days in custody and 253 days on an electronic curfew — the equivalent to 127 days in custody.

McDonagh’s offending began at 8.40pm on February 27 when he was refused permission to board a bus driven by Antan Mubaiwa because he was carrying a beer can.

Having left the can outside he got on the bus and said to the driver, “here you go, you black *******”.

At 11.15pm the defendant urinated into the garden of neighbour Elyas Masih before racially abusing him and shouting “I’m going to smash your door in’.

McDonagh then refused to talk to an Asian officer and used further racist language.

Jon Riley, defending, said his client had schizophrenia which was managed by medication, but added: “When he doesn’t take his medication he hears voices, he acts in a rather strange and bizarre way.”
