A bid by a Domino's Pizza to open all hours on a Witney estate has been rejected by councillors.
West Oxfordshire District Council refused the plan for the Neighbourhood Centre in Madley Park over concerns about the impact on neighbours.
The firm applied to remove a condition of its original 2006 planning permission that bars it from operating 24 hours a day, seven days a week.
It argued a change in hours would provide an “additional service” to residents on the estate.
The outlet is currently barred from opening between midnight and 8am.
Witney Town Council objected, branding it “totally unacceptable to residents”.
It said: “The noise from vehicles arriving and departing the car park will be disruptive to these residents, as will customers arriving by foot.”
No neighbours objected, despite letters being sent by the district council to 36 properties.
The council’s environmental health officer said no complaints about noise or smells had been received prior to the application.
The officer, however, objected to the plan, saying complaints are more likely at night and it could see youths gather, leading to a “noisy anti-social element”.
The council’s lowlands area planning sub-committee rejected the plan on Monday over noise and odour concerns and fears it would set a precedent.
