Marriotts Stadium Limited, who rent their pitch to Witney Town, are taking legal action against Swindon referee Bob Desmond following the recent abandoned game against Dartford.
The pitch was turned into a sea of mud following Desmond's decision to give the Dr Martens League game which was subsequently abandoned after 69 minutes the go-ahead on April 12.
Brian Constable, managing director and senior shareholder of Marriotts Stadium, said they were sueing Desmond for loss of earnings and damage to their property estimated at 20,000 under common law. Constable said that the FA and the Dr Martens League had fail to respond to his letters, and now he was writing to UEFA in Switzerland requesting a change in the rules which allows the referee to be the sole arbiter on whether a game takes place.
