A SIX-YEAR-OLD boy from Blackbird Leys has won a multi-million pound NHS compensation package after he was left brain damaged by complications during his birth.

Dontay Crooks was delivered at Oxford’s John Radcliffe Hospital in August 2005 but his lawyers claimed he was brain damaged due to oxygen starvation during labour.

The youngster, who appeared at London’s High Court on Friday in a wheelchair, is visually impaired, has epilepsy and will need 24-hour care for the rest of his life.

Mother Damali Ochiela, of Butterworth Place, sued the Oxford University Hospitals NHS Trust, which, while continuing to dispute liability in the case, agreed to a settlement.

As well as a £1m lump sum, the youngster will get annual payments to cover the costs of his care for life.

His barrister, Martin Spencer QC, said Dontay’s brain damage was caused by the over-use of a labour-inducing drug during his birth.

But he said he could not prove negligence on the part of hospital staff and, had Dontay’s case been fought out in court, there was a risk the family would lose altogether.

Trust barrister Judith Rogerson said: “We do hope this settlement will provide security for Dontay and we wish the family well for the future.”
