Sir – I note the comments made by Mr Mitchell regarding the legal challenge to the Secretary of State’s decision to grant planning approval for Viridor Waste Management to construct a 300,000 tonnes/ year Incinerator at Ardley.

Mr Mitchell could make his case through the same legal channel that Ardley Against Incinerator is using. He has chosen not to do so. In the meantime we would comment as follows: Our challenge is not “self serving”. We have taken these steps, funded from our own pockets, in order to protect all residents and businesses in Oxfordshire.

We have repeatedly requested that Mr Mitchell waits until planning permission for the facility is granted before signing a contract — in order to avoid the millions of pounds in penalties that he is now accusing us of exposing Oxfordshire taxpayers to.

In not waiting until the end of the period in which a legal challenge could be made he has naively underestimated and ignored both the concerns of our group and its supporters — and the strength of its resolve.
