A driver who narrowly avoided hitting protective cones at the scene of a crash and made an obscene gesture at police has been sentenced.

Nathan Moss, aged 33, of Darius Way, Swindon pleaded guilty to driving without due care and attention at a hearing on Thursday (26/1) at High Wycombe Magistrates’ Court.

He was sentenced to a £40 fine, given four points on his licence and ordered to pay costs and a victim surcharge of a total of £126.

The incident happened when three officers were at the scene of a crash on the A34 northbound near to Junction 9 of the M40 at Wendlebury on Wednesday October 26.

One lane had been closed so that officers could assist.

At around 1.20pm they heard horns blaring and saw a red Citroen Berlingo undertaking another vehicle.

The Berlingo swerved and narrowly missed the cones, which were there to protect the officers and the motorists involved in the crash.

An officer shouted towards the motorist, who slowed down and made a hand gesture at the officers.

The index of the vehicle was taken. Dashcam footage of the incident showed the poor manner of the driver, later identified as Moss.

He was charged on 20 December 2022.

PC Amy Boughton of the Joint Operations Roads Policing Unit, said: “Road safety is a responsibility for all road users and workers.

“Fortunately no one was injured in this incident but this is a reminder that lanes are closed to create a safe working area for those involved. It is done with the intention that it will reduce disruption to others.

“We will always work as quickly as we can to open the roads again however the priority is to keep everyone safe and when this is not complied with, we will take it seriously and investigate and refer these matters to the courts”.
