An alleged rapist told detectives who interviewed him that he had consensual sex the woman he was accused of sexually assaulting.

Max Warner, 30, who denies rape and sexual assault by penetration, said that she was upset after they had unprotected sex.

But he denied using force. “There wasn’t a scream. There wasn’t pushing, there wasn’t anything like that. I don’t know where the rest of it has come from.”

Jurors at Oxford Crown Court heard that Warner and his alleged victim had texted each other following the encounter in his Mitsubishi 4x4 in woods near Bruern, south of Chipping Norton, on February 8, 2019.

The woman told him: “What you did tonight was awful.” She had been ‘terrified’ and that Warner had ‘scared’ her, she added. He replied ‘I didn’t mean to’ and said over a series of messages that he would buy the morning after pill the following day and added he was a ‘waste of space’.

Asked about the messages in his police interview, he told detectives: “I didn’t want to make her feel it was her fault. All I did was reassure her about going to the chemist.”

Warner, of Dawls Close, Ascott-under-Wychwood, denies rape and sexual assault and penetration.
