THE family of a man who died after a crash on the A34 are angry that one of the drivers who caused his death will be out of jail in five months.

The family of John Kilty, who died after the crash, are set to take legal advice about getting a harsher sentence for Richard Brown, 56.

Lorry driver Brown, of Seaford, Cheshire, stopped on the A34 in Oxfordshire to make a telephone call just before the crash, Oxford Crown Court heard last Friday. He was jailed for ten months after he was convicted of causing death by dangerous driving.

Peter Smith, 47, from Winchester, who pleaded guilty to a similar offence, was jailed for eight months.

Both defendants will serve half their sentences before they are released.

Jennifer Edwards, prosecuting, said Brown, stopped on the southbound carriageway between Pear Tree and Botley on December 14, 2004, before Smith's lorry collided with it. Mr Kilty's car transporter then collided with Smith's lorry.

Mr Kilty was from Co Durham. His brother, Ged Kilty, 46, speaking after the sentencing, said: "I am still in shock about the sentence for Brown.

"I am all right about the sentence handed out to Smith because it was not his fault, but if Brown had not been making a phone call while parked on the dual carriageway none of this would have happened and our John would be here now. I am disgusted and so is the rest of my family.

"We were hoping he would get no less than five years. He took my brother's life.

"The family are seeking legal advice because we want to take this further.

"We will be looking towards making an appeal to make sure he gets a harsher sentence."
