A COURT action which has delayed a planned new retail park for Banbury will be heard in November.
The owners of Castle Quay shopping centre and Banbury Cross Retail Park are trying to get a judicial review of the scheme. Cherwell District Council has approved the construction of a retail park, to include a Marks & Spencer and Next, at motorsport firm Prodrive’s current site alongside the M40.
The company plans to move to the former Hella lighting site on the nearby Wildmere Industrial Estate.
Prodrive is hoping to move late next year, with an opening in 2015.
The judicial review was brought by Aegon and Scottish Widows Investment Partnership (SWIP), which own Banbury Cross and Castle Quay.
Neither firm was available for comment.
The case will be heard at the High Court on November 6 and 7.
