A COURT case over the ownership of a £1m house in North Oxford has taken yet another twist.

Yesterday, an eviction hearing was due to resume at Bicester Magistrates' Court after it was dramatically adjourned in November.

The case has been brought by Nigerian Abbey Folami, 46, who says he is the rightful owner of 17 Warnborough Road in North Oxford, after he legally bought it for £108,000 plus some land in Nigeria, and he is seeking to evict tenants Philip Brown and Keiron Halstead.

Chief Obasola Atobatele was the previous owner, but died in June 1989.

In November, as the case was about to close, another Nigerian man, Ade Atobatele, stood up claiming to be the chief’s son and said he had information about the case.

Yesterday, Richard Devereux-Cooke, who is representing Mr Folami, told Recorder Alastair Wilson: “We thought there might be relevant intervention but that appears to have fizzled out.”

But before proceedings could get started yesterday the court heard another twist in the saga.

Property developer Martin Young, a friend of Mr Brown and Mr Halstead, obtained a court order from Brentford Magistrates court to release documents held by the Metropolitan Police relating to a separate case, which involved two people who have “featured” in the Folami case. The only details given in the Bicester court were that the matter related to a criminal investigation.

John Clargo, who is representing the tenants, told the court: “My submission is the documentation is clearly relevant to issues of the case and would go in as evidence of the case.”

Recorder Wilson said he was reluctant to adjourn the case again, but said if that meant justice could be done, he would.

A date has not been set for when it will resume.
