Compulsory Purchase Of Land And New Rights Along And Adjacent To The A40 Principal Road, From Just West Of Hill Farm Overbridge, Witney, In The West Eastwards To East Of The A34 Western Bypass Bridge Crossing Of The A40
Principal Road, Wolvercote, In The East

Notice is hereby given that Oxfordshire County Council has made The Oxfordshire County Council (Highways Infrastructure - A40 HIF 2 Smart Corridor (Hill Farm to Dukes Cut)) Compulsory Purchase Order 2022 under Sections 239, 240, 246, 250 and 260 of the Highways Act 1980 (as amended) and Parts II and II of Schedule 2, and Schedule 3 to the Acquisition of Land Act 1981. It is about to submit this Order to the Secretary of State for Transport for confirmation, and if confirmed, the Order will authorise Oxfordshire County Council to purchase compulsorily the land and the new rights described below for the purposes of: -
(1) the improvement of the A40 -

(a) from a point 174 metres west of the Hill Farm Overbridge, which carries Bridleway 353/19/20 (South Leigh) over the A40, eastwards for a distance of approximately 689 metres, to a point 64 metres west of the junction of the A40 with the Private Access Track to Whitehouse Farm and Nos 1 and 2 Whitehouse Farm Cottages; and

(b) from a point 146 metres east of its junction with the westerly Private Access Track to Salutation Farmhouse and Salutation Barn, generally eastwards for a distance of approximately 9.758 kilometres, to a point 134 metres east of the centre line of the A34 Western Bypass bridge over the A40;

(2) the construction of a highway, as the proposed A40, from a point on the existing A40 approximately 64 metres west of the junction of the A40 with the Private Access Track to Whitehouse Farm and Nos 1 and 2 Whitehouse Farm Cottages, eastwards for a distance of approximately 415 metres to a point approximately 146 metres east of the junction of the A40 with the westerly Private Access Track to Salutation Farmhouse and Salutation Barn;

(3) the construction of highways, the improvement of highways, and the provision of new means of access to premises in pursuance of The Oxfordshire County Council (Highways Infrastructure - A40 HIF 2 Smart Corridor (Hill Farm to Dukes Cut)) (Side Roads) Order 2022;

(4) the provision of other new means of access to premises, as may be necessary;

(5) the carrying out of works on watercourses, including the diversion of non-navigable watercourses, in connection with the construction and improvement of highways and the provision of new means of access to premises as aforesaid;

(6) use by the acquiring authority in connection with the construction and improvement of highways and the provision of new means of access to premises as aforesaid;

(7) the improvement or development of frontages to the above-mentioned new and existing highways or of the land adjoining or adjacent thereto; and

(8) mitigating the adverse effect which the existence or use of the highways to be constructed or improved will have on the surroundings thereof.

Any objection to the Order must be made in writing to the Secretary of State for Transport, Department for Transport, National Transport Casework Team, Tyneside House, Skinnerburn Road, Newcastle Business Park, Newcastle upon Tyne NE4 7AR or by email to national

casework@dft.gov.uk

before 14 September 2022, and should state the title of the Order, the grounds of the objection and the objector's address and interests in the land. It should be noted that your personal data and correspondence will be passed by the Secretary of State for Transport to the Acquiring Authority to enable your objection to be considered. Where the Order becomes the subject of Public Local Inquiry procedures, all correspondence is copied to the Inspector conducting the Inquiry and will be kept in the Public Inquiry library, where it is made available for public access. If you do not wish your personal data to be forwarded, please state your reasons when submitting your objection and the Secretary of State will copy your representations, with your name and address removed, to the Acquiring Authority and if there is to be a Public Local Inquiry they will be seen by the Inspector, who may give them less weight as a result.


Description Of The Land And The New Rights The Land

 to be compulsorily acquired is described in the Schedule to the Order and is shown coloured pink on the associated Order Map (Sheets 1 to 19). It comprises a land corridor of approximately 10.86 kilometres in length and amounting to 79.14 hectares of land.
The land corridor commences approximately 174 metres west of Hill Farm Overbridge, Witney, in the west, and travels along the A40 Principal Road corridor and land immediately adjacent to it, to a point approximately 134 metres east of the centre line of the A34 Western Bypass bridge over the A40 Principal Road, at Wolvercote. The land includes the entirety of the existing A40 Principal Road between those two points and, from west to east along the corridor, other highways and rights of way which cross or adjoin the A40 (Bridleway 353/19/40 (South Leigh), Bridleway 353/19/20 (South Leigh), Bridleway 353/19/30 (South Leigh), Footpath 206/22/10 (Eynsham), Footpath 206/33/10 (Eynsham), Unclassified Road (43655199), C35469, Unclassified Road (43607679), Unclassified Road (43603545), Bridleway 206/13/10 (Eynsham), Cuckoo Lane, Witney Road, Bridleway 206/9/10 (Eynsham), Bridleway 206/9/20 (Eynsham), Hanborough Road, Lower Road, B4449, Cassington Road, Eynsham Road, Horsemere Lane/Restricted Byway 152/4/10 (Cassington), Bridleway 420/21/30 (Yarnton), Footpath 229/12/10 (Gosford and Water Eaton), Footpath 229/11/10 (Gosford and Water Eaton), and Bridleway 320/15/10
(Oxford)).
Otherwise, from west to east, the land comprises - Hill Farm Overbridge to Barnard Gate
(a) Agricultural frontage land of Hill Farm;

(b) Agricultural frontage land of Green Farm/associated with Green Farm Cottages;

(c) Agricultural pasture frontage land lying to the east of the C35469 at Barnard Gate;

(d) Agricultural frontage land of Barnard Gate Farm;

(e) Agricultural frontage land of Ambury Close Farm;

(f) Agricultural frontage land of Fir Tree Farm/Nursery;

(g) Agricultural frontage land of Home Farm;

(h) Agricultural frontage land of Barnard Lodge Farm;

(i) Agricultural frontage land of Twelve Acre Farm; Barnard Gate to A40/Lower Road/B4449 Roundabout

(j) Frontage land to the A40 of Eynsham Motocross (associated with City Farm); (k) Agricultural frontage land of Home Farm; (l) Agricultural frontage land of City Farm; (m) Agricultural frontage land of Evenlode Farm; (n) Frontage woodland, to the east of Cuckoo Lane;
(o) Part of the Eynsham Mead ditch, lying to the north east of the A40/Lower Road/B4449 Eynsham Roundabout junction;
A40/Lower Road/B4449 Roundabout to west side of Dukes Cut Canal
(p) Agricultural frontage land, lying to the north and south of the A40 Principal Road, from east of the of the A40/Lower Road/B4449 Eynsham Roundabout junction eastwards, to just east of the A40 crossing over the non-navigable River Evenlode and just west of the Rygor Mercedes Benz Commercial Dealership;
(q) Frontage Access Roads connecting on the north and south sides of the A40 leading to and from M & M Waste Solutions/Severn Trent Green Power Cassington/Worton Farms;
(r) Agricultural frontage land, lying to the north and to the south of the A40 Principal Road, from just east of Marlborough Pool, generally eastwards to the west side of Dukes Cut Canal;

Dukes Cut Canal to east of A34 Western Bypass bridge crossing over the A40 Principal Road

(s) Grassed and woodland embankment frontage on the north side of the A40 between
Dukes Cut Canal and the Oxford, Worcester and Wolverhampton Railway; (t) Grassed and woodland embankment frontage on the north and south sides of the A40
between the Oxford, Worcester and Wolverhampton Railway and the Oxford Canal; (u) Agricultural frontage on the north side of the A40 between the Oxford Canal and the
A34 Western Bypass bridge over the A40 Principal Road; and (v) Grassed frontage land on the north side of the A40 and works access track/prospective development land on the south side of the 40, over a 134 metres length eastwards of the A34 Western Bypass bridge over the A40 Principal Road, at Wolvercote. THE NEW RIGHTS to be compulsorily acquired are described in the Schedule to the Order and are shown coloured blue on the associated Order Map (Sheets 4, 6, 11, 13, 14, 17, and 18). They are sought over agricultural land of Green Farm and the adjacent western bank of Chil Brook; over agricultural land of Twelve Acre Farm, opposite Eynsham Motocross; over the non-navigable River Evenlode and adjacent agricultural land to its eastern and western sides; over a length of Access Track to Cassington Sewage Pumping Station; over the Access Roads to and from M & M Waste Solutions/Severn Trent Green Power/Worton Farms, where they adjoin the northern and southern sides, and proceed under, the A40 Principal Road, and of certain adjoining agricultural land alongside those Access Road lengths at the location of their underpass crossing of the A40 Principal Road; over the Kingsbridge Brook on the northern side of the A40 Principal Road; and over a woodland planted area, and tree planted northern embankment of the A40 Principal Road, lying to the west of the Oxford Canal. The rights include one or more of the rights listed below, but not all of which relate to each particular area of the aforementioned land -

Access and General Construction
To enter the land at all times (with or without vehicles, machinery, equipment, plant and materials) for all purposes necessary in connection with the surveying, demolition, construction, maintenance, inspection, use, renewal, repair, reinstatement, cleaning, decoration, connection, removal and replacement of land, property, structures and buildings adjacent to or abutting the land and the right to manage access to such parts of the land to accord with safe working practices (but without requiring exclusive possession of such land) including entering onto land, property, structures and buildings to make good and carry out protective works, boundary treatment works, to re-grade, re-surface and landscape land, carry out support works from properties adjoining the land and to carry out accommodation and reconfiguration works to land where access is reconfigured in order to modify the retained land so that it can be brought back into
beneficial use._

Oversail
To oversail and/or sail a crane or cranes (including, but not limited to, mobile crane platforms, jibs and booms and all associated equipment), loaded or unloaded through the airspace over the land and/or water together with the right to temporarily set up exclusion zones for public safety and to accord with safe construction practices.

Scaffolding/Hoarding/Safety Fencing
To erect, secure, use, decorate, clean, maintain, repair, renew, replace and take support for scaffolding and/or hoardings and/or safety fencing (including signage) on land or land adjoining or abutting the boundaries of the land for the purpose of construction, demolition, maintenance, inspection and repair of land, highways and structures adjacent to or abutting the land, including but not limited to cradle scaffolding for the survey,
construction, inspection and ongoing maintenance of any bridge structure._

Service Media
To disconnect, install, lay, strengthen, connect to, divert, alter, use, maintain, repair, replace, renew, inspect and remove the surface media in, over or under the land as necessary and to make good any damage caused in connection with the exercise of these rights.

Plant

To disconnect, remove, install, lay, strengthen, maintain, inspect and replace plant equipment on, in, under or over the land (as necessary) and to make good any damage
caused in the exercise of these rights.

Amendments To Access/Egress Arrangements
To alter, divert, replace and/or remove access/egress routes (either on a temporary or permanent basis) forming part of or used by the land whilst always providing an alternative means of access/egress from the land whilst carrying out such works and to grant rights for owners and occupiers of land to use said access/egress routes.

Future Inspections And Maintenance
To enter the land at all times (with or without vehicles, machinery, equipment, plant and materials) for all purposes necessary in connection with the maintenance and inspection of the improved road, including any road bridge structures to be improved, with any ancillary support structures, drains, earthworks, scour protection measures, structural connections and components, bridge abutments and bridge deck or other structures
or development on the land._

Condition Surveys
To enter the land on foot only and temporarily remain on the land for the purposes of carrying out non-intrusive condition surveys in accordance with safe working practices and to document the condition of the land before, during and after development, if so
necessary._

Deliveries
To access the land at all times (with or without vehicles, machinery, equipment, plant and materials) for the purposes of delivery, removing and sorting materials, plant and machinery, and the right (from time to time) to create, divert and/or otherwise manage pedestrian and vehicular access to, on and across land to facilitate the delivery of the scheme (including the ongoing maintenance and inspection of the scheme) and to accord
with safe working practices.

Discharge of Water
To discharge uncontaminated surface waters, land drainage waters and waters from highway drains into the new watercourse channel outfall to be constructed as part of the
scheme in order to enable satisfactory operation of the channel outfall.

Ecological Mitigation
The right of access with or without vehicles, plant and machinery to carry out, maintain, and inspect ecological and environmental mitigation works, including (as necessary) the installation, inspection, repair and maintenance of landscape fencing, fencing to protect planting from livestock, kingfisher boxes, bat boxes.

River/Canal/Water Channel Bank Access
The right of access with or without vehicles, plant and machinery over the banks of any river/canal/water channel in the land in connection with improvement works to any river/ canal/water channel and its embankments, including reinforcement works necessary as a result of the improved highway._
