SOUTH OXFORDSHIRE DISTRICT COUNCIL NOTICE OF MAKING
SOUTH OXFORDSHIRE DISTRICT COUNCIL (OFF-STREET PARKING PLACES) (NO.1) ORDER 2021
NOTICE IS HEREBY GIVEN that South Oxfordshire District Council (the Council) has made the above Order in exercise of its powers under Sections 32,33(4) and 35 of the Road Traffic Regulation Act 1984 ("the Act") and Part IV of Schedule 9 of the Act, and of all other enabling powers; with the consent of Oxfordshire County Council in accordance with Section 39(3) of the Act and after consultation with the Chief Officer of Police in accordance with Part iii of Schedule 9 of the Act. The Order is dated 14 May 2021 and comes into force on 1 June 2021.

The Order contains various provisions concerning enforcement with regard to the operation of the car parks and enforcement in relation to payment of charges and other conditions of use. The Council has :-
a) revoked the South Oxfordshire District Council (Off-Street Parking Places) Order 2011.

b) made the South Oxfordshire District Council (Off-Street Parking Places) (No.1) Order 2021 that include the following provisions that differ from the previous Orders:

c) aligned all charging car parks in the centre of market towns of Didcot, Henley, Wallingford and Thame, as well as Goring, to all have up to one hour of free parking between the charging hour, and to amend charging hours to 9am to 5pm Monday to Saturday in all charging car parks, with the exception of Goldsmiths Lane car park, Wallingford which has up to two hours no charge;

d) to introduce charging on Sundays in all charging car parks from 10am to 5pm, including on free hour, with the exception of Goldsmiths Lane car park, Wallingford;

e) introduce limited waiting at High Street Car Park, Chinnor between the hours of 9am to 5pm, Monday to Saturday with a maximum stay of two hours (no charge);

f) to introduce spaces (bays) reserved for electric vehicles whilst charging and enforcement for unauthorised parking in those reserved spaces for i) parking in those spaces with a vehicle that is not an electric vehicle and ii) for parking an electric vehicle in those spaces but without charging the vehicle;

g) to introduce half price tickets for electric vehicles (able to run at least 20 miles on zero C02 and revoke the current offer of half price tickets for low emission vehicles (those vehicles under 120 g C02/km), with the exception of Goldsmiths Lane, Wallingford.

The charges and other conditions of use of the car parks are set out in a table attached to this Notice. In addition to those charges and other conditions of use, the position of a vehicle using any of the car parks referred to in the table must be wholly within a parking bay, a disabled persons parking bay, an electric vehicle recharge bay or a motor-cycle bay as indicated by markings and in accordance with the terms of the Order. Furthermore, if due to contraventions of the Order, it is necessary to issue an Excess Charge, a penalty will be payable (max £70). The Orders, Schedule of Charges (including a list of contraventions which may result in an Excess Charge being imposed and the penalty payable) and a statement of the Council's reasons for making the Order will be available for inspection at the Council office at 135 Eastern Avenue, Milton Park, Milton, Oxfordshire, 0X14 4SB. Due to Covid-19 restrictions these documents can only be inspected in person by appointment only as the office is currently closed to the public. Any person wishing to question the validity of the Orders or of any of its provisions on the grounds that it or they are not within the powers conferred by the Act, or that any requirement of the Act or of any instrument made under the Act has not been complied with, may apply for the purpose to the High Court within six weeks of the date this Order is made.
