NOTICE OF CONFIRMATION OF AN ORDER PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER HIGHWAYS ACT 1980, WILDLIFE AND COUNTRYSIDE ACT 1981
The Oxfordshire County Council, Nuffield Footpath No. 25 and Stoke Row Footpath No. 24 (part) Public Path Diversion and Definitive Map and Statement Modification Order 2015
On 5th November 2019, the Secretary of State for Environment. Food and Rural Affairs confirmed the above Order made on 15th September 2015 under section s119 of the Highways Act 1980 and section 53A(2) of the Wildlife and Countryside Act 1981. The effect of the Order as confirmed is to modify the Definitive Map and Statement for the area by diverting 230m of Nuffield Fp 25 and Stoke Row Fp 24 that runs from Howberry Lane (Nuffield Br No. 17) at OS Grid Ref SU 6887 8570 south-westwards across the garden of Howberry wood Farm and then west-north-westwards across an arable field over the Nuffield and Stoke Row Parish boundary to SU 6865 8574 to a line running for 305m from Howberry Lane (Nuffield Br No. 17) at OS Grid Ref SU 6890 8567 south-westwards through a wood and across a field and over the Nuffield and Stoke Row Parish boundary to SU 6882 8561 and then north-westwards along field margin to re-join Stoke Row Fp 24 at SU 6865 8574 as shown on the Order map.

The Order came into force on the date of confirmation but if any person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 (the Act), as amended, and/or the powers of section 53A of the Wildlife and Countryside Act 1981 (WCA) or on the ground that any requirement of either Act or of any regulation made under them has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act and as applied by s53A(7) WCA, within six weeks from 5th December 2019 make an application to the High Court.
