A FATHER who attacked his partner when she threw his shoes out the window of their flat during a row has avoided jail.

Michael Wilson admitted assaulting the mother of his son Aisha Fraser following an argument in April.

The court heard that 33-year-old Wilson would stay at her home in Windrush Tower in Knights Road, Blackbird Leys, two or three times a week.

David Matthews, prosecuting, told Oxford Crown Court on Thursday that a row erupted on the evening of April 21.

He said: “She asked him to leave and backed up that request by throwing some of his property in a bag out of the window. This prompted him to hit her and she was injured as a result. She had a split lip.”

The court heard that despite Ms Fraser wishing to withdraw her complaint, Wilson, of Brake Hill, Blackbird Leys, was arrested.

He told police he had got “p***** off” when his now ex-partner had thrown his shoes out the window.

But the court heard that the attack put Wilson in breach of an eight-month prison sentence for stealing a TV and laptop during a burglary, which was suspended for two years at the same court in June last year.

Julian Lynch, defending, said his client had settled their disputes, even though they were no longer together.

Judge Ian Pringle said: “Domestic violence is an ugly form of violence because it is behind closed doors and no else sees it.”

The judge said he would be well within his rights to activate the suspended sentence but said a two-year community order would be more “constructive”.
