Brothers' golf club row goes to court as county threatens to seize assets

TWO golf club owners who were jailed over the extension of their course are returning to court to battle with Oxfordshire County Council.

The Wyatt brothers face having their assets taken away in their dispute with the local authority.

Waste material from the construction of the M40 services was used to extend the brothers’ course at Waterstock Golf Club, near Wheatley, in the 1990s.

Officials at the county council claim the brothers, Mick and Ron, did not have the correct permission to use the waste.

The authority also claims the brothers, aged 76 and 72 respectively, have done nothing to remove the waste, despite them being sent to prison over it.

Now Oxfordshire County Council is seeking a court date for taking possession of some of their assets.

That would pay for the authority to do the work itself.

The council would then have to head in and reclaim the waste, which now forms the basis of a golf course.

Ron Wyatt, who spent three months in prison, said: “There is no waste on the site that we brought on to it. I don’t think it is in the public interest for the council to pursue this. It will mean ripping up a site that has been very well manicured.

“Applying to sequester our assets is not very nice and unnecessary.”

The council says the brothers should have sought permission from it before carrying out the extension work.

It was in 1998 that the brothers received a first injunction ordering them to clear the waste.

After no work was carried out, a High Court order was issued in 2005.

In December 2012, the two brothers appeared at the Court of Appeal in London in a final attempt to avoid jail.

But a panel of three High Court judges found in favour of the county council and the pair were sent to prison.

The brothers are expecting to appear in court again in June or July, when a judge will decide if the county council can take hold of their assets.

County council spokesman Paul Smith said: “The council is keen for the Wyatts to remove the waste. They have taken no steps to do so in contravention of the injunction and despite receiving custodial sentences.

“We have applied for sequestration of their assets. This will enable money to be raised to pay for the waste removal by ourselves. The Wyatts object to that process and the court is considering their objections.”

The Oxford Mail asked Mr Smith how much money the council was seeking to recover from the Wyatts’ assets to pay for the work, but he did not respond.

Oxfordshire County Council is responsible for planning permission, relating to the management of waste and the extraction of minerals.

This will give them valuable land near to the M40 which they could further develop.
Something stinks about the council's dogged persuit of the Wyatt's when other golf courses were allowed to keep the same soil, which they had used in the same way. Why the Wyatt's and no-one else?

It is fact that the Wyatt's have removed all of the waste soil that they brought onto the site and the County Council have all of the waste transfer notes to prove this fact. What is unclear is why the County Council have not prosecuted the Oxford City Council who have tipped 2,500 tonnes of contaminated waste into the former pools at Hinksey Park Members of the public should know that the City Council carried this work out in November 2013 WITHOUT PLANNING PERMISSION and the County Council are fully aware of what has taken place,they have allowed the City Council to carry out this unlawful act by suggesting that the City Council Can act as the waste authority "in this instance" and give themselves permission! Surely, if true, this is a much stronger storyline than the supposedly 'illegal' activities of this golf club? It would also bring to public attention what has been thought for many years about what local authorities get away with - especially rumours about planning. As for 'self regulation' it seems obvious (from banking to energy supply) that self regulation often works against the public interest. It's also interesting to hear the rumours over the years about local authority planners alegedly using their powers to grant or deny planning permission for theor own ends - such as trying to force developers to include 'social housing' quotas, or allow building development which isn't always in the public interest.

This is just a disgusting waste of our public funds. Harassing two elderly men who have done nothing wrong.

I would love to know exactly how much this has cost US as residents. Perhaps the dodgy council workers who falsified the documents and plans originally would like to pay us back so we can have some pot holes fixed or our children can have a bus ride FOC to school!

Why would the Wyatts spend all the money they have worked hard for over many years on court costs?

Answer: Because they believe in justice, fairness and honesty.

It would have been far cheaper for them to give in to OCC's ridiculous requests. Problem was the 'waste' has been removed and even OCC cannot advise the Wyatts where they allege this to be.

Are we as good citizens of Oxford and Oxfordshire going to allow OCC to take away the Wyatt's family home. They've already instigated action which sent them both to prison on falsified plans.

Please, please can somebody somewhere right this huge injustice :-((
