A JURY was yesterday told the three murder suspects on trial were the only ones who could have killed homeless man Denis Witney.

Prosecutor Neil Moore made the comments in his closing statement as the five-week long trial at Oxford Crown Court draws to an end.

Daniel McCollin, 30, Wayne Cattell, 37, and Joanne Moriarty, 29, all deny beating Witney, 39, at a St Clement’s Street house in November last year.

But Mr Moore said the evidence showed all three were part of the “aggressive and unpleasant”

attack on Mr Witney which left him with fatal injuries.

Mr Witney was wounded while he was in the house with McCollin, Cattell, Moriarty, and twin sisters Diane and Katey Hayes, Mr Moore said. But the evidence showed Katey was upstairs and Diane was not involved, he added.

He said Moriarty had called Cattell and boyfriend McCollin to the house when she discovered Mr Witney there because he had recently assaulted her. And he said telephone records backed this up.

He also said reliable witnesses had described Cattell arriving first and Mr Witney being “unpleasantly” ejected from the house soon after.

Mr Moore said: “It is easy to infer what happened in that house behind closed doors when Wayne Cattell got back as some of it spilled out onto the street.”

The trial continues and is expected to finish early next week.
